Thank you for your interest in participating in our inner journey day retreat. Before purchasing the ticket, we ask you to carefully go through the following information.

During our day together, we will use a combination of microdosing, cacao, breathwork and sound healing. These modalities all have a profound effect on your mental and physical state. This document will give you an overview of the most important contra indications and general information that is important when you participate in our day. 

GENERAL CONTRAINDICATIONS FOR BREATHWORK

Below you will find a list of general contraindications for breathwork. Due to privacy rules, we cannot ask you to share your medical history/file with us. For your own safety, the safety of your fellow participants and for ours, it is of utmost importance that you are aware of your responsibility to take these contraindications seriously and consult with us about your participation if there is anything on this list that applies or might apply to you. 

• Pregnancy(at any stage)
• Severe PTSD or trauma
• Actively using recreational drugs
• Taking any medication that alters brain chemistry like anti-anxiety, anti-depressant, ADD, OCD medications etc.
• Detached Retina
• Glaucoma
• Kidney disease
• High Blood Pressure
• Cardiovascular disease, including angina, previous heart attack or stroke
• Diagnosis of aneurysm of any kind
• Uncontrolled thyroid conditions
• Diabetes(any type)
• Severe Asthma - for mild to moderate asthma, we can discuss but you must bring your inhaler to the session
• Epilepsy
• History of seizures
• Prior diagnosis of bipolar disorder, schizophrenia or previous psychiatric condition
• Severe psychosomatic disorders
• Recent surgery, stitches or injury
• Hospitalization for any psychiatric condition or emotional crisis within the last 10 years

If you have any health conditions or injuries that may interfere with your ability to join, please let us know! That way we can make sure that everyone can have a beautiful and meaningful experience. 

MICRODOSING

During our day retreat we will work with microdosing.  In short: a microdose is a hardly noticeable dose of a psychedelic substance that has been scientifically shown to increase focus, learning capacity, creativity and other amazing things. We’ll provide the psilocybin truffle which is relatively mild, completely safe and 100% legal here in the Netherlands. During the retreat, we will give an introduction after which it is up to you to decide if you would like to join. It's simply a tool that is available.
A few important points about this:

1. If you are on any kind of medication or have experience with mental illness, first consult your physician or psychiatrist (and let us know!).
2. If you wish to partake, first watch this great introductory talk and read this excellent guide so that you are well informed. 
3. You are responsible for dosing appropriately and keeping it micro. The aim is to get a helpful support for learning and creativity, not to trip out. Of course we will help you determine appropriate dosage.
   
   
   

SIGNING
The modalities we use can be very intense and go very deep. For us it is important to be certain that all measures considering safety and responsibility, contraindications etc. have been communicated clearly and understood by all our participants. Therefore, we ask you to read this document and tick the box as to confirm you have done so.

It is important that you apply anything and everything that you learn and experience with us in a safe environment. Therefore, never practice the breathing or meditation techniques before or during diving, driving, swimming, taking a bath or any other environment/place where it might be dangerous to faint or get dizzy. Also it is important to never force yourself or anyone else to do the practices. Make sure that you are aware of the potential risks, that you know how to practice them safely and that you instruct others on how to practice safely.

Privacy Regulations of Breathwork Masterclass

We use a number of definitions in our Privacy Regulations that can be used in the singular or plura

Cookie: a small file that is placed via an internet site on (the IP address of) your computer which records information about your visit to the Breathwork Masterclass internet site; Regulations: these Privacy Regulations;
Privacy legislation: the Act Implementing the General Data Protection Regulation; Breathwork Masterclass: Breathwork Masterclass and the activities under the brand names; Breathwork Masterclass and Kaspersfocus.

1. Explanation of the Regulations

Breathwork Masterclass may not automatically process the data with which you provide it. Privacy legislation is intended to protect the privacy of persons. This legislation restricts the permitted use of your personal data by others. Under this Act, Breathwork Masterclass has the duty to its clients

• inform them of the way in which and the purpose for which data are processed by Breathwork Masterclass;
• state who is allowed to inspect the data;
• request permission to process certain data.

Breathwork Masterclass considers your privacy important. That is why Breathwork Masterclass explains in these Regulations how it deals with your data, what the purpose is of its use, and for the processing of which data Breathwork Masterclass must explicitly request your permission.

2. The personal data Breathwork Masterclass uses and the purpose of such use

Breathwork Masterclass (may possibly) process your data if you: • are or will become a client of Breathwork Masterclass;

• are a coach via Breathwork Masterclass;
• do business with Breathwork Masterclass;
• register for newsletters from Breathwork Masterclass; • get in touch with us via the contact form.

Breathwork Masterclass collects your name, address, telephone number, email address and a record of your orders if you are a client. In addition, Breathwork Masterclass processes, if necessary for a specific product or service also dietary restrictions username, password, language and your experience and motivation for a course.

Breathwork Masterclass collects your name, address, telephone number and email address if you are a coach. In addition, Breathwork Masterclass processes username, password, profile photo, education, training institutes, work experience, preferred languages, GPS coordinates of the location of your practice location and the address of your website to create your profile.

Breathwork Masterclass collects your name, address, telephone number and email adress if you contact us via the contact form on the website of if you sign up fort he newsletters.

Breathwork Masterclass collects your name, address, telephone number and email adress if you do business with us.

These data enable us to:

• finalise the contract clients conclude with Breathwork Masterclass financially and administratively;
• comply with our obligations as an employer;
• provide our services;
• reach clients or interested parties if this is necessary;
• develop/further optimise our services;
• provide you with customised information (direct marketing).

IP addresses/cookies
Breathwork Masterclass keeps IP addresses of clients or prospective clients who visit the

website. These data enable us to:

• record which internet site/internet pages you visit;
• improve the functionality and contents of the website;
• keep track of the subjects or applications in which prospective clients are interested;
• ensure that you do not constantly receive the same information;
• improve the range of products.

Explanation of the placement of cookies

When you visit our website cookies are automatically placed that allow us to keep certain information up to date on the basis of your IP address. This concerns, for example, information on how often you visit our website and in which topics you are interested. For more information, see our cookie policy on the website.

3. Provision of personal data to third parties
Breathwork Masterclass does not provide any personal data to persons or businesses outside

the Breathwork Masterclass organisation, unless:

• this is required by a statutory provision;
• this is necessary to perform a contract that Breathwork Masterclass has concluded with you;
• you have given permission to do so.

4. Obligations/secured access/confidentiality/retention period

• Breathwork Masterclass processes your personal data only in accordance with the law. This means, among other things, that the data are processed only for the purpose for which they are obtained and in a proper/careful manner in accordance with the law and these Regulations.
• Your personal data can be inspected only by the staff of Breathwork Masterclass, unless stipulated otherwise in these Regulations. All your personal data are protected by Breathwork Masterclass against unauthorised access. The protection consists of:
  – having a personal password for each employee to login to the digital system;
  – having two-factor authentication protection for our client/CRMsystems;
• the staff of Breathwork Masterclass have a duty of confidentiality with respect to al personal data provided to Breathwork Masterclass;
• Breathwork Masterclass has taken technical measures in accordance with the law to
  protect the system it uses against external data breaches;
• your personal data are not kept longer than necessary for proper administration. The
  law may prescribe a different retention period. If this is the case, Breathwork Masterclass will adhere to the prescribed statutory retention period.

5. Your rights as a person concerned

• Right to information: the right to know which personal data of yours are processed and for what purpose;
• Right of inspection: the right to inspect and obtain copies of those data as long as this does not violate someone else’s privacy;
• The right to correct, add to or delete data should this be necessary (right of correction and deletion). The right to request total or partial deletion of your data can be honoured only if the retention of the data is not of considerable importance to someone else and the data do not have to be retained pursuant to a statutory provision;
• The right of opposition: the right to oppose the processing of your data in certain cases.

Booking Conditions & Cancellation Policy 
Events Breathwork Masterclass

We understand that sometimes plans change, and you may be unable to attend an event you’ve booked with us. Below are the terms and conditions that apply:

For 5 day masterclasses & events

Payment & Booking:

• upon booking*: 
  • option 1: full price is charged
  • option 2: a €300 deposit is required to secure your spot 
• if option 2: 8 weeks before the event the remaining balance of the payment will be charged, unless a different payment plan has been agreed upon in advance

* a payment plan is possible, you can apply for that in the payment process

Cancellation Policy:

• up until 8 weeks before the event: free of charge, deposit will be refunded
• 8 to 6 weeks before the event: 25% of the total price will be charged
• 6 to 4 weeks before the event: 50% of the total price will be charged
• 4 to 2 weeks before the event: 75% of the total price will be charged
• Within 2 weeks before the event: 100% of the total price will be charged

Rescheduling Policy:

Each booking includes one opportunity to reschedule to another planned date if needed

• up to 6 weeks before the event: free of charge

Within 6 weeks before the event: The rescheduling fee follows the cancellation structure*:

• 6 to 4 weeks before the event: 50% of the total price will be charged
• 4 to 2 weeks before the event: 75% of the total price will be charged
• Within 2 weeks: 100% of the total price will be charged
  
  

* if we find a replacement for your spot before the start of the event we will transfer your booking to your newly chosen date free of charge

Cancellation & Rescheduling Options

Cancellation:

• Up to 2 weeks before the event: contact us for a full refund or to reschedule for the same event on a different date, free of charge.

Within 2 weeks of the event, cancellation is not possible.

Rescheduling:

• 2 to 1 week before the event: contact us to reschedule for the same event at a later date, free of charge. If it’s a one-time event or no future dates are planned, this option may not apply.
• Within 1 week before the event: 

If you cannot attend, we recommend selling your ticket to a friend or through TicketSwap. If you’ve signed a waiver or confirmed understanding of contraindications, please notify us if you transfer your ticket to someone else, as the new attendee will also need to acknowledge these conditions

General Terms and Conditions of Breathwork Masterclass  

Breathwork Masterclass BV is  registered with the Chamber of Commerce under number 89450884 and is located at Duurstedelaan 79, 3525AN Utrecht. Customer service is available at +31850161492 on business days between 10:00 and 16:00 (standard European Time Zone).

Article 1 Terms

1. In these general terms and conditions the following terms have the following meanings, unless explicitly stated otherwise.
2. Company: The natural or legal person trading as a professional or business.
3. Client: the Company entering into a (remote) Agreement with the Service Provider.
4. Service Provider: the legal person that provides services (remotely) to the Client, hereinafter referred to as: Mindlift Learning.
5. Offer: Any written Offer to the Client for the provision of Services by the Service Provider.
6. Services: the services Offered by Mindlift Learning include coaching, online courses, workshops, training courses and more.
7. Products: the Product that Mindlift Learning offers is the book “Mindlift. Mental Fitness for the Modern Brain”.
8. Order: the execution of the Agreement by Mindlift Learning with respect to the services or Product requested by the Client.
9. Agreement: the Agreement for the provision of services commissioned by the Client.
10. The websites used by Mindlift Learning are https:// www.mindlift.com and https://www.breathworkmasterclass.com

Article 2 Applicability

1. These general terms and conditions apply to every Mindlift Learning Offer, every Agreement between Mindlift Learning and the Client and to every service offered by Mindlift Learning.
2. Prior to the conclusion of a (remote) Agreement, the Client will be provided with these general terms and conditions. If this is not reasonably possible, Mindlift Learning will inform the Client on how the Client can view the general terms and conditions, which is published on the Mindlift Learning website so that the Client can easily save these general terms and conditions on a durable data carrier.
3. The possible applicability of general terms and conditions of the Client and third parties is expressly rejected.
4. Deviation from these general terms and conditions is essetially not possible. In exceptional situations, it is possible to deviate from these general terms and conditions if this has been explicitly agreed upon in writing with Mindlift Learning. The Client’s terms and conditions are not explicitly inapplicable.
5. These general terms and conditions also apply to additional, amended and follow-up Orders from the Client.
6. If one or more provisions of these general terms and conditions are partially or completely invalid or are annulled, the remaining provisions of these general terms and conditions will be maintained, and the invalid/annulled provision(s) will be replaced by a provision with the same purport as the original provision.
7. Uncertainties about the content, explanation or situations that are not regulated in these general terms and conditions should be assessed and explained in accordance with these general terms and conditions.
8. The applicability of Articles 7:404 and 7:407(2) of the Dutch Civil Code is explicitly excluded.

Article 3 The Offer

1. All Offers made by Mindlift Learning are without obligation, unless explicitly stated otherwise in writing. If the Offer is limited or valid under specific conditions, this will be explicitly stated in the Offer.
2. The Offers of Mindlift Learning are without obligation. Mindlift Learning is only bound by an Offer if acceptance is confirmed in writing by the Client within 14 days. Nevertheless, Mindlift Learning has the right to refuse an Agreement with a potential Client for a well-founded reason for Mindlift Learning.
3. The Offer contains a complete and accurate description of the services offered. The description is so detailed that Client is able to make a proper assessment of the Offer. Obvious mistakes or errors in the Offer cannot bind Mindlift Learning. Any images and specific data in the Offer are only an indication and cannot be a ground for any compensation or the dissolution of the Agreement.
4. Delivery times included in the Mindlift Learning Offer are indicative and, if exceeded, will not give the Client any right to dissolution or compensation, unless explicitly agreed otherwise.
5. A compound quotation does not oblige Mindlift Learning to deliver part of the items included in the Offer or quotation for a corresponding part of the quoted price.

Article 4 Realisation of the Agreement

1. The Agreement comes into effect at the moment that the Client has accepted an Offer of Mindlift Learning.
2. If the Client has accepted the Offer by giving an Order to Mindlift Learning, Mindlift Learning will confirm the Client’s Order in writing by e-mail. Each Offer is valid for a maximum of 14 days, after which Mindlift Learning can no longer be held to an Offer.
3. Mindlift Learning will not be bound by an Offer if the Client could reasonably have expected or should have understood that the Offer contains an obvious mistake or typographical error. The Client cannot derive any rights from this mistake or error.
4. An Offer is only valid if made in writing by Mindlift Learning to the Client.
5. In principle, the right of withdrawal does not apply to the retreat.
6. If the Client cancels an Order already confirmed with regard to a lecture, the costs actually incurred will be charged to the Client, as well as at least 50% of the agreed price as laid down in the Agreement.

Article 5 Duration of the Agreement

1. If and insofar as an Agreement has been concluded between the Client and Mindlift Learning, the duration of this Agreement shall be in accordance with what the parties have agreed.
2. Both the Client and Mindlift Learning may dissolve the Agreement on the basis of an attributable failure to comply with the Agreement only if the other party has been given notice of default in writing, as well as a reasonable period of time to comply with its obligations, and it fails imputably in this respect. This also includes the payment and cooperation obligations of the Client.
3. The dissolution of the Agreement shall not affect the payment obligations of the Client if Mindlift Learning has performed work or provided services at the time of dissolution. The Client must pay the agreed fee.
4. The Client is not authorised to terminate an Agreement prematurely. The Client, being a consumer, can cancel an Agreement free of charge up to 48 hours before the start date of a course. After this, at least 50% of the agreed amount will be charged.
5. If the Client terminates the Agreement prematurely, he shall owe at least 50% of the agreed price. This amount may be increased by costs incurred by Mindlift Learning for travel and accommodation costs, as well as costs for the location and other costs to be incurred by the Client.
6. Both the Client and Mindlift Learning can terminate the Agreement in whole or in part in writing without further notice of default with immediate effect in the event that one of the parties is in suspension of payment, has filed for bankruptcy or the Company in question is liquidated or otherwise than by merging or restructuring the Company. If a situation such as that mentioned above arises, Mindlift Learning will never be obliged to refund any money already received and/or compensation for damages.

Article 6 Additional work and amendments

1. If, during the execution of the Agreement, it appears that the Agreement needs to be adjusted and/or supplemented, or if, at the request of the Client, further work is necessary to achieve the desired result of the Client, the Client is obliged to pay for this additional work in accordance with the agreed rate. Mindlift Learning is not obliged to comply with this request, and may require the Client to enter into a separate Agreement for this purpose.
2. If and insofar as a fixed price has been agreed upon for the provision of certain services, and the performance of those services leads to extra (urgent) work that cannot reasonably be deemed to be included in the fixed price, Mindlift Learning shall be entitled, after consultation with the Client, to charge these costs to the Client.

Before doing or participating in any of our work, we ask you to carefully go through the following information.

Understanding how the body responds to different (extreme) stimuli is essential to breathwork mastery and your ability to coach others. This part of the preparation document will give you an overview of the most important contra indications and general information that is important when you undergo or give breathwork sessions. If you are planning to put into practice what you learn with us, please stick to these guidelines. Share this information with your own participants when you give sessions.

BODYWORK
Bodywork is a part of the coaching exercises that will be applied to each other. Bodywork may include being touched, massaged or asked to assume certain positions. It may include things like massaging the diaphragm, poking your fingers in a muscle to cue correct movement or massaging tissues around the rib cage. It is very important that you feel safe and comfortable and to have an atmosphere where we communicate openly and directly about things we’re not comfortable with. Therefore, always be aware of your boundaries around touch and clearly voice anything that does not feel right to you. It is also important to point out any physical injuries around the rib cage or the belly during bodywork sessions.

CODE OF CONDUCT
Our team is there to support you in your best possible experience. For this, we have defined some guidelines of proper conduct that our team is asked to uphold. If you are interested in reading these guidelines, you can find them here.

First and foremost we care 100% for your health and safety, no matter what.   

Article 8 Prices and payment

1. All prices are exclusive of VAT in the course of the Client’s profession or business. For Consumers, the price includes VAT. If Mindlift Learning carries out all or part of the assignment at the Client’s location or, at the Client’s request, at an external location, additional costs (travel and accommodation expenses and parking fees) may be charged. This will be discussed with the Client in advance.
2. In the event of urgency, or if Mindlift Learning has to perform its work urgently based on instructions from the Client, the Client is obliged to reimburse the additional costs of the urgency.
3. If Parties have agreed on a down payment, this down payment must be paid by the Client before Mindlift Learning commences its activities.
4. The Client cannot derive any rights or expectations from a budget issued in advance, unless the parties have explicitly agreed otherwise.
5. In the event of a periodic payment obligation on the part of the Client, Mindlift Learning is authorised to adjust the applicable prices and rates (only) in writing in accordance with the terms and conditions of the Agreement, with due observance of a period of at least three months.
6. The Client is obliged to pay for the services of Mindlift Learning as stated in the Agreement, and must pay the agreed amount within 14 days from the invoice date.
7. The Client must pay these costs at once, per invoice, to the account number and details of Mindlift Learning made known to him. Except in very special circumstances, the Client may only agree on a further term in which the amount due is to be paid with the explicit and written consent of Mindlift Learning.
8. If explicitly agreed, the Customer must pay the amount owed per prepayment before Mindlift Learning commences its services.

Article 8 Collection policy

1. If the Client does not fulfil the payment obligation, and has not fulfilled this obligation within the payment term of 14 days, the Client (if he has done the job in as a professional or a business without further notice of default) will be in default and the Client will receive a written reminder with a request to pay the amount due within the term set therein.
2. From the date that the Client is in default, Mindlift Learning will, without further notice of default being required, claim the statutory (commercial) interest (being at least 5% per annum) from the first day of default until full payment, and compensation of the extrajudicial costs in accordance with Article 6:96 of the Dutch Civil Code, to be calculated in accordance with the graduated scale from the decree on compensation for extrajudicial collection costs of 1 July 2012.
3. If Mindlift Learning has incurred more or higher costs which are reasonably necessary, these costs are eligible for reimbursement. Judicial and execution costs incurred are also at the expense of the Client.

Article 9 Implementation of the Agreement

1. Mindlift Learning will make every effort to implement the Agreement with the utmost care as may be required of a good contractor. All services are performed on the basis of an obligation to perform to the best of one’s abilities, unless a result has been explicitly agreed upon in writing, which has been described in detail.
2. In executing the services, Mindlift Learning is not obliged or required to follow the instructions of the Client if this alters the content or scope of the agreed services. If the instructions result in additional work for Mindlift Learning, the Client will be obliged to reimburse the additional costs accordingly.
3. The Client ensures that all information which Mindlift Learning indicates is necessary or which the Client should reasonably understand is necessary for the implementation of the Agreement, is provided to Mindlift Learning in a timely manner. If the information required for the implementation of the Agreement is not provided to Mindlift Learning in a timely manner, Mindlift Learning is entitled to suspend the implementation of the Agreement and/or to charge the additional costs arising from the delay to the Client in accordance with its usual rates.
4. Mindlift Learning is entitled to engage third parties for the implementation of the services at its own discretion.
5. Mindlift Learning is not liable for damage, of whatever nature, caused by Mindlift Learning based on incorrect and/or incomplete information provided by the Client.
6. If work is performed by Mindlift Learning or third parties engaged by Mindlift Learning in the context of the instruction at the location of the Client or a location designated by the Client, the Client shall provide the facilities reasonably required free of charge.

Article 10 Client’s obligations

1. In the event of replacement of a participant, due to unforeseen circumstances on the part of the participant and/or the Client, the latter must inform Mindlift Learning of this as soon as possible.
2. The Client must comply with the minimum and maximum number of participants for the service in question. If there are too few participants, the service in question can be cancelled by Mindlift Learning. If possible, the service can be moved to another date and/or location. If this is not possible, the Client will receive paid funds back.
3. If explicitly agreed, the Client must, at the first request of Mindlift Learning, arrange for the provision of the requested facilities (such as a representative room, Beamer, flipchart, etc.).

Article 11 Conditions for Retreat

1. The services provided by the retreat are covered by the travel contract in Book 7, Title 7A of the Dutch Civil Code.
2. The Client can apply for the Retreat as long as the Offer is valid. There may be additional conditions to be met by the Client.
3. The travel contract can be changed in consultation with Mindlift Learning. Mindlift Learning will inform the Client as soon as possible if any costs are involved. Changes can only be made up to one month prior to the commencement date, unless otherwise indicated by Mindlift Learning.
4. The travel contract can only be cancelled free of charge up to one month before the commencement date. After this, the contract can be cancelled up to two weeks before the commencement date with a maximum refund of 50% of the agreed amount. If the Client has not yet paid the full amount, Mindlift Learning must be consulted about any refund.
5. During the retreat, some activities can be organised. If the Client suffers from health complaints, use of medication or other circumstances that may influence participation in the activities, the Client must report this to Mindlift Learning in a timely manner. The Client is responsible for participation in these activities. All damage suffered by the Client during the retreat as a result of not reporting relevant information, is explicitly at the risk and expense of the Client.

Article 12 (Re)Delivery

1. If the commencement, progress or (re)delivery of the services or work is delayed because, for example, the Client has not provided all requested information or has not provided all requested information on time, provides insufficient assistance, the advance payment has not been received on time by Mindlift Learning or due to other circumstances that are at the expense and risk of the Client, Mindlift Learning is entitled to a reasonable extension of the term of (re)delivery.
2. All damage and additional costs resulting from a delay due to a cause referred to in paragraph 1 will be at the expense and risk of the Client and Mindlift Learning will charge the costs to the Client.
3. If it concerns a step-by-step execution, or if the Client needs to give its approval, Mindlift Learning is entitled to suspend the execution of the Agreement until the moment the Client has given its approval.
4. Mindlift Learning makes every effort to provide its services within the agreed period of time, insofar as this can reasonably be expected of it. In the event of urgency, the Client is obliged to reimburse Mindlift Learning for the additional costs involved.
5. The nature of Mindlift Learning’s activities means that work can only commence once all the necessary information has been provided by the Client. The Client will bear the risk and any (damage) if he/she has not provided the necessary information in a timely manner, and expressly indemnifies Mindlift Learning against all consequences and possible resulting damage for the Client and Mindlift Learning.
6. If the Client has purchased a Product from Mindlift Learning, the Client is entitled to return the book only if the book is in good condition, without damage. A buyer may only exercise its right of withdrawal within 14 days after purchase has been made.

Article 13 Transfer of risk

The risk of theft and loss, misappropriation or damage to data, documents, software, data files and/or items used, created or supplied in the context of the execution of the Agreement is transferred to the Client as soon as they are actually made available to the Client.

Article 14 Retention of title

1. All items delivered by Mindlift Learning remains the property of Mindlift Learning until the Buyer has complied with all following obligations under all Agreements concluded with Mindlift Learning.
2. The buyer is not authorised to pledge or encumber the goods subject to the retention of title in any other way.
3. If third parties seize goods delivered under retention of title or wish to establish or assert rights to them, the buyer is obliged to inform Mindlift Learning of this as soon as can reasonably be expected.
4. The buyer undertakes to insure the goods delivered subject to retention of title and to keep them insured against fire, explosion and water damage as well as against theft and to make the policy of this insurance available for inspection upon first request.
5. In the event that Mindlift Learning wishes to exercise its property rights referred to in this article, the buyer hereby grants unconditional and irrevocable permission to Mindlift Learning or third parties to be appointed by Mindlift Learning to enter all places where Mindlift Learning’s property is located and to repossess those items.
6. Mindlift Learning has the right to retain the Product(s) purchased by the Buyer if the Buyer has not (fully) fulfilled its payment obligations, despite an obligation of Mindlift Learning to transfer or issuance. After the Buyer has fulfilled his obligations, Mindlift Learning will deliver the purchased Products to the Buyer as soon as possible, but at the latest within 20 working days.
7. Costs and other (consequential) damage as a result of keeping the purchased Products in possession is at the expense and risk of the Buyer and will be reimbursed to Mindlift Learning by the Buyer on first request.

Article 15 Privacy, data processing and security

1. Mindlift Learning treats the (personal) data of the Client and users of the website with care and will only use them in accordance with the privacy statement. If requested, Mindlift Learning will inform the person concerned. 2. The Client is responsible for the processing of data that is processed using a Mindlift Learning service. The Client also guarantees that the content of the data is not unlawful and does not infringe any rights of third parties. Within this framework, the Client indemnifies Mindlift Learning against any (legal) claim related to these data or the implementation of the Agreement.
3. If Mindlift Learning is required by the Agreement to provide security for information, this security will comply with the agreed specifications and a level of security that is not unreasonable in view of the state of the art, the sensitivity of the information and the associated costs.
4. All information obtained within the framework of the Agreement will be treated confidentially and with the utmost care.

Article 16 Suspension

1. Mindlift Learning is entitled to retain the data, data files, software and other items received or realised by the Client if the latter has not yet (fully) fulfilled its payment obligations, regardless of whether it would have been obliged to do so had it been paid.
2. Mindlift Learning is authorised to suspend the fulfilment of its obligations as soon as the Client is in default with the fulfilment of any obligation arising from the Agreement, including late payment of its invoices. The suspension will be confirmed to the Client in writing immediately. In that case, Mindlift Learning will not be liable for damage, in whatever form, resulting from the suspension of its activities.

Article 17 Force majeure

1. Mindlift Learning is not liable if, as a result of a force majeure situation, they are unable to fulfil their obligations under the Agreement.
2. Force majeure on the part of Mindlift Learning is in any case understood to mean, but is not limited to: (i) force majeure on the part of suppliers of Mindlift Learning, (ii) failure to properly fulfil obligations of suppliers prescribed or recommended by the Client to Mindlift Learning, (iii) defects in goods, equipment, software or materials of third parties, (iv) government measures, (v) electricity failure, (vi) failure of the internet, data network and telecommunication facilities (for example as a result of: cybercrime and hacking), (vii) natural disasters, (viii) war and terrorist attacks, (ix) general transport problems and (x) other situations which, in the opinion of Mindlift Learning, fall outside its sphere of influence which temporarily or permanently prevent it from fulfilling its obligations.
3. If a situation of force majeure lasts longer than 2 months, the Agreement may be dissolved in writing by either party. In the event that any performance has already been made on the basis of the Agreement, payment will be made on a pro rata basis, without any liability on the part of either party towards each other.

Article 18 Limitation of liability

1. If the provision of services and/or performance of Orders by Mindlift Learning leads to liability on the part of Mindlift Learning, such liability is limited to the costs charged in connection with the Order, in the event of an attributable shortcoming in the compliance with the Agreement or in the event that damage has otherwise arisen.
2. Mindlift Learning is not liable for consequential damage, indirect damage, trading loss, loss of profit and/or losses, missed savings, damage due to business stagnation and damage resulting from the use of services provided by Mindlift Learning.
3. The amount of compensation is further limited to the amount paid out by Mindlift Learning’s liability insurance for each event per year.
4. Mindlift Learning is not liable for damage that is or may be the result of any act or omission as a result of (incomplete and/or incorrect) information on the website or that of linked websites.
5. Mindlift Learning is not liable for errors and/or irregularities in the functionality of the website and/or the software, malfunctions or the unavailability of the website and/or software for whatever reason.
6. Mindlift Learning does not guarantee the correct and complete transmission of the content of and e-mail sent by/on behalf of Mindlift Learning, nor its timely receipt.
7. The Client guarantees the accuracy and completeness of the information and wishes provided with regard to the job. Mindlift Learning expressly excludes all liability for (consequential) damage.
8. All claims of the Client due to shortcomings on the part of Mindlift Learning will lapse if these have not been reported to Mindlift Learning in writing, stating reasons, within one year after the Client was aware or could reasonably have been aware of the facts on which it bases its claims.

Article 19 Confidentiality

1. Mindlift Learning and the Client undertake to maintain the confidentiality of all confidential information obtained in the context of the Order. Confidentiality ensues from the Order or that which can reasonably be expected to involve confidential information.
2. In particular, the confidentiality relates to advice and/or reports drawn up by Mindlift Learning regarding the Client’s instructions. The Client is expressly prohibited from sharing the content thereof with employees who are not authorised to have knowledge of it and with (unauthorised) third parties. The Client must delete the advice and/or report at the request of Mindlift Learning. In the event of a breach of this stipulation, Mindlift Learning is entitled to recover the material and immaterial damage suffered from the Client.
3. If Mindlift Learning is required on the basis of a statutory provision or a judicial decision to (also) provide the confidential information to a third party indicated by law or a competent court, and Mindlift Learning cannot invoke a right to refuse to give evidence, Mindlift Learning will not be obliged to pay any compensation and the Client will not be entitled to dissolve the Agreement.
4. Mindlift Learning and the Client will also impose the confidentiality obligation on third parties to be engaged by them.

Article 20 Intellectual Property Rights

1. All IP rights and copyrights of Mindlift Learning belong exclusively to Mindlift Learning and are not transferred to Client.
2. The Client is prohibited from disclosing and/or reproducing, altering or making available to third parties all documents and software covered by the IP rights and copyrights of Mindlift Learning without the express prior written consent of Mindlift Learning and an agreed financial compensation. If the Client wishes to make changes to items delivered by Mindlift Learning, Mindlift Learning must explicitly agree to the intended changes.
3. The Client is prohibited from using the Products on which Mindlift Learning’s intellectual property rights are based otherwise than agreed upon in the Agreement.
4. Any infringement by the Client of Mindlift Learning’s intellectual property rights shall be punishable by a one-off fine of € 15,000 (in words: fifteen thousand euros) and a fine of € 500 (in words: five hundred euros) for each day that the infringement continues.
5. Mindlift Learning can, for promotional and advertising purposes, take pictures of the services it provides and publish them on its website and/or social media channels.

Article 21 Protection and accuracy of information

1. The Client is responsible for the correctness, reliability and completeness of all data, information, documents and/or records it provides to Mindlift Learning in the context of the Order. Even if these data originate from third parties, the Client is responsible for this.
2. The Client indemnifies Mindlift Learning against any liability as a result of not or not timely fulfilling the obligations under the previous paragraph.
3. The Client indemnifies Mindlift Learning against claims by third parties regarding intellectual property rights on the data and information provided by the Client, which can be used in the execution of the Order or Agreement, as well as regarding the content of the advice and reports drawn up by Mindlift Learning.
4. If the Client provides electronic files, software or information carriers to Mindlift Learning, the Client guarantees that these are free of viruses and defects.

Article 22 Complaints

1. If the Client is not satisfied with the service or Products of Mindlift Learning or otherwise has complaints about the execution of the Order, the Client is obliged to report these complaints as soon as possible, but at the latest within 2 weeks after the relevant reason that led to the complaint. 2. The complaint must be sufficiently substantiated and/or explained by the Client in Order for Mindlift Learning to be able to deal with the complaint.
3. Mindlift Learning will respond to the content of the complaint as soon as possible, but at the latest within 14 days after receipt of the complaint.
4. The parties will try to reach a solution together.

Article 23 Applicable law

1. The legal relationship between Mindlift Learning and the Client is governed by Dutch law. The applicability of the Vienna Sales Convention (CISG) is expressly excluded.
2. Mindlift Learning may unilaterally amend these general terms and conditions. The most current version can be found on the website.
3. All disputes arising from or as a result of the Agreement between Mindlift Learning and the Client will be resolved by the competent court of Utrecht, unless provisions of mandatory law designate another competent court.

Artikel 1 - Definities In deze voorwaarden wordt verstaan onder:

1.  Bedenktijd: de termijn waarbinnen de consument gebruik kan maken van zijn herroepingsrecht;
2. Consument: de natuurlijke persoon die niet handelt in de uitoefening van beroep of bedrijf en een overeenkomst op afstand aangaat met de ondernemer;
3. Dag: kalenderdag;
4. Duurtransactie: een overeenkomst op afstand met betrekking tot een reeks van producten en/of diensten, waarvan de leverings- en/of afnameverplichting in de tijd is gespreid;
5. Duurzame gegevensdrager: elk middel dat de consument of ondernemer in staat stelt om informatie die aan hem persoonlijk is gericht, op te slaan op een manier die toekomstige raadpleging en ongewijzigde reproductie van de opgeslagen informatie mogelijk maakt.
6. Herroepingsrecht: de mogelijkheid voor de consument om binnen de bedenktijd af te zien van de overeenkomst op afstand;
7. Ondernemer: de natuurlijke of rechtspersoon die producten en/of diensten op afstand aan consumenten aanbiedt;
8. Overeenkomst op afstand: een overeenkomst waarbij in het kader van een door de ondernemer georganiseerd systeem voor verkoop op afstand van producten en/of diensten, tot en met het sluiten van de overeenkomst uitsluitend gebruik gemaakt wordt van één of meer technieken voor communicatie op afstand;
9. Techniek voor communicatie op afstand: middel dat kan worden gebruikt voor het sluiten van een overeenkomst, zonder dat consument en ondernemer gelijktijdig in dezelfde ruimte zijn samengekomen.
10. Algemene Voorwaarden: de onderhavige Algemene Voorwaarden van de ondernemer.

Artikel 3 - Toepasselijkheid

1. Deze algemene voorwaarden zijn van toepassing op elk aanbod van de ondernemer en op elke tot stand gekomen overeenkomst op afstand en bestellingen tussen ondernemer en consument.
2. Voordat de overeenkomst op afstand wordt gesloten, wordt de tekst van deze algemene voorwaarden aan de consument beschikbaar gesteld. Indien dit redelijkerwijs niet mogelijk is, zal voordat de overeenkomst op afstand wordt gesloten, worden aangegeven dat de algemene voorwaarden bij de ondernemer zijn in te zien en zij op verzoek van de consument zo spoedig mogelijk kosteloos worden toegezonden.
3. Indien de overeenkomst op afstand elektronisch wordt gesloten, kan in afwijking van het vorige lid en voordat de overeenkomst op afstand wordt gesloten, de tekst van deze algemene voorwaarden langs elektronische weg aan de consument ter beschikking worden gesteld op zodanige wijze dat deze door de consument op een eenvoudige manier kan worden opgeslagen op een duurzame gegevensdrager. Indien dit redelijkerwijs niet mogelijk is, zal voordat de overeenkomst op afstand wordt gesloten, worden aangegeven waar van de algemene voorwaarden langs elektronische weg kan worden kennisgenomen en dat zij op verzoek van de consument langs elektronische weg of op andere wijze kosteloos zullen worden toegezonden.
4. Voor het geval dat naast deze algemene voorwaarden tevens specifieke product- of dienstenvoorwaarden van toepassing zijn, is het tweede en derde lid van overeenkomstige toepassing en kan de consument zich in geval van tegenstrijdige algemene voorwaarden steeds beroepen op de toepasselijke bepaling die voor hem het meest gunstig is.
5. Indien één of meerdere bepalingen in deze algemene voorwaarden op enig moment geheel of gedeeltelijk nietig zijn of vernietigd worden, dan blijft de overeenkomst en deze voorwaarden voor het overige in stand en zal de betreffende bepaling in onderling overleg onverwijld vervangen worden door een bepaling dat de strekking van het oorspronkelijke zoveel mogelijk benaderd.
6. Situaties die niet in deze algemene voorwaarden zijn geregeld, dienen te worden beoordeeld ‘naar de geest’ van deze algemene voorwaarden.
7. Onduidelijkheden over de uitleg of inhoud van één of meerdere bepalingen van onze voorwaarden, dienen uitgelegd te worden ‘naar de geest’ van deze algemene voorwaarden.

Artikel 4 - Het aanbod

1. Indien een aanbod een beperkte geldigheidsduur heeft of onder voorwaarden geschiedt, wordt dit nadrukkelijk in het aanbod vermeld.
2. Het aanbod is vrijblijvend. De ondernemer is gerechtigd het aanbod te wijzigen en aan te passen.
3. Alle prijzen zijn inclusief BTW weergegeven, tenzij anders vermeld.
4. Het aanbod bevat een volledige en nauwkeurige omschrijving van de aangeboden producten en/of diensten. De beschrijving is voldoende gedetailleerd om een goede beoordeling van het aanbod door de consument mogelijk te maken. Als de ondernemer gebruik maakt van afbeeldingen zijn deze een waarheidsgetrouwe weergave van de aangeboden producten en/of diensten. Kennelijke vergissingen of kennelijke fouten in het aanbod binden de ondernemer niet.
5. Alle afbeeldingen, specificaties gegevens in het aanbod zijn indicatie en kunnen geen aanleiding zijn tot schadevergoeding of ontbinding van de overeenkomst.
6. Afbeeldingen bij producten zijn een waarheidsgetrouwe weergave van de aangeboden producten. Ondernemer kan niet garanderen dat de weergegeven kleuren exact overeenkomen met de echte kleuren van de producten.

Artikel 5 - De overeenkomst

1. De overeenkomst komt, onder voorbehoud van het bepaalde in lid 4, tot stand op het moment van aanvaarding door de consument van het aanbod en het voldoen aan de daarbij gestelde voorwaarden.
2. Indien de consument het aanbod langs elektronische weg heeft aanvaard, bevestigt de ondernemer onverwijld langs elektronische weg de ontvangst van de aanvaarding van het aanbod. Zolang de ontvangst van deze aanvaarding niet door de ondernemer is bevestigd, kan de consument de overeenkomst ontbinden.
3. Indien de overeenkomst elektronisch tot stand komt, treft de ondernemer passende technische en organisatorische maatregelen ter beveiliging van de elektronische overdracht van data en zorgt hij voor een veilige webomgeving. Indien de consument elektronisch kan betalen, zal de ondernemer daartoe passende veiligheidsmaatregelen in acht nemen.
4. De ondernemer kan zich - binnen wettelijke kaders - op de hoogte stellen of de consument aan zijn betalingsverplichtingen kan voldoen, evenals van al die feiten en factoren die van belang zijn voor een verantwoord aangaan van de overeenkomst op afstand. Indien de ondernemer op grond van dit onderzoek goede gronden heeft om de overeenkomst niet aan te gaan, is hij gerechtigd gemotiveerd een bestelling of aanvraag te weigeren of aan de uitvoering bijzondere voorwaarden te verbinden.
5. De ondernemer zal bij het product of dienst aan de consument de volgende informatie, schriftelijk of op zodanige wijze dat deze door de consument op een toegankelijke manier kan worden opgeslagen op een duurzame gegevensdrager, meesturen:
   a. het adres van de vestiging waar de consument met klachten terecht kan;
   b. de voorwaarden waaronder en de wijze waarop de consument van het herroepingsrecht gebruik kan maken, dan wel een duidelijke melding inzake het uitgesloten zijn van het herroepingsrecht;
   c. de informatie over garanties en bestaande service na aankoop;
   d. de in artikel 4 lid 3 van deze voorwaarden opgenomen gegevens, tenzij de ondernemer deze gegevens al aan de consument heeft verstrekt vóór de uitvoering van de overeenkomst;
   e. de vereisten voor opzegging/annulering van de overeenkomst indien de overeenkomst een duur heeft van meer dan één jaar of van onbepaalde duur is.
6. In geval van een duurtransactie is de bepaling in het vorige lid slechts van toepassing op de eerste levering.
7. Iedere overeenkomst wordt aangegaan onder de opschortende voorwaarden van voldoende beschikbaarheid van de betreffende producten.

Artikel 6 - Herroepingsrecht

Bij levering van producten: Bij de aankoop van producten heeft de consument de mogelijkheid de overeenkomst zonder opgave van redenen te ontbinden gedurende 14 dagen. Deze bedenktermijn gaat in op de dag na ontvangst van het product door de consument of een vooraf door de consument aangewezen en aan de ondernemer bekend gemaakte vertegenwoordiger.

1. Tijdens de bedenktijd zal de consument zorgvuldig omgaan met het product en de verpakking. Hij zal het product slechts in die mate uitpakken of gebruiken voor zover dat nodig is om te kunnen beoordelen of hij het product wenst te behouden. Indien hij van zijn herroepingsrecht gebruik maakt, zal hij het product met alle geleverde toebehoren en - indien redelijkerwijze mogelijk - in de originele staat en verpakking aan de ondernemer retourneren, conform de door de ondernemer verstrekte redelijke en duidelijke instructies.
2. Wanneer de consument gebruik wenst te maken van zijn herroepingsrecht is hij verplicht dit binnen 14 dagen, na ontvangst van het product,  kenbaar te maken aan de ondernemer. Het kenbaar maken dient de consument te doen middels een e-mail naar Dit e-mailadres wordt beveiligd tegen spambots. JavaScript dient ingeschakeld te zijn om het te bekijken.. Nadat de consument kenbaar heeft gemaakt gebruik te willen maken van zijn herroepingsrecht dient de klant het product binnen 14 dagen retour te sturen. De consument dient te kunnen bewijzen dat de geleverde zaken tijdig zijn teruggestuurd, bijvoorbeeld door middel van een bewijs van verzending.
3. Indien de klant na afloop van de in lid 2 en 3 genoemde termijnen niet kenbaar heeft gemaakt gebruik te willen maken van zijn herroepingsrecht resp. het product niet aan de ondernemer heeft teruggezonden, is de koop een feit.

Bij levering Abonnementen:

4. Voor de maandelijkse abonnement heeft de ondernemer geen mogelijkheid tot retourneren, de consument kan het abonnement opzeggen en verdere betalingen zullen stopgezet worden.
   Ben je echt niet tevreden met de kwaliteit neem dan contact op en we overleggen de mogelijkheden.
5. Bij een jaarlijks abonnement heeft de consument de mogelijkheid de overeenkomst zonder opgave van redenen te ontbinden gedurende 7 dagen.
6.  Bij een lifetime abonnement heeft de consument de mogelijkheid de overeenkomst zonder opgave van redenen te ontbinden gedurende 14 dagen.

7. Bij levering van diensten heeft de consument de mogelijkheid de overeenkomst zonder opgave van redenen te ontbinden gedurende ten minste 14 dagen, ingaande op de dag van het aangaan van de overeenkomst.
8. Om gebruik te maken van zijn herroepingsrecht, zal de consument zich richten naar de door de ondernemer bij het aanbod en/of uiterlijk bij de levering ter zake verstrekte redelijke en duidelijke instructies.

  Artikel 7 - Kosten in geval van herroeping

1. Indien de consument gebruik maakt van zijn herroepingsrecht, komen ten hoogste de kosten van terugzending voor zijn rekening.
2. Indien de consument een bedrag betaald heeft, zal de ondernemer dit bedrag zo spoedig mogelijk, doch uiterlijk binnen 14 dagen na herroeping, terugbetalen. Hierbij is wel de voorwaarde dat het product reeds terug ontvangen is door de webwinkelier of sluitend bewijs van complete terugzending overlegd kan worden.

  Artikel 8 - Uitsluiting herroepingsrecht

1. De ondernemer kan het herroepingsrecht van de consument uitsluiten voor producten zoals omschreven  in lid 2 en 3. De uitsluiting van het herroepingsrecht geldt slechts indien de ondernemer dit duidelijk in het aanbod, althans tijdig voor het sluiten van de overeenkomst, heeft vermeld.
2. Uitsluiting van het herroepingsrecht is slechts mogelijk voor diensten:

a. betreffende logies, vervoer, restaurantbedrijf of vrijetijdsbesteding te verrichten op een bepaalde datum of tijdens een bepaalde periode; b. waarvan de levering met uitdrukkelijke instemming van de consument is begonnen voordat de bedenktijd is verstreken;   Artikel 9 - De prijs

1. Gedurende de in het aanbod vermelde geldigheidsduur worden de prijzen van de aangeboden producten en/of diensten niet verhoogd, behoudens prijswijzigingen als gevolg van veranderingen in btw-tarieven.
2. In afwijking van het vorige lid kan de ondernemer producten of diensten waarvan de prijzen gebonden zijn aan schommelingen op de financiële markt en waar de ondernemer geen invloed op heeft, met variabele prijzen aanbieden. Deze gebondenheid aan schommelingen en het feit dat eventueel vermelde prijzen richtprijzen zijn, worden bij het aanbod vermeld.
3. Prijsverhogingen binnen 3 maanden na de totstandkoming van de overeenkomst zijn alleen toegestaan indien zij het gevolg zijn van wettelijke regelingen of bepalingen.
4. Prijsverhogingen vanaf 3 maanden na de totstandkoming van de overeenkomst zijn alleen toegestaan indien de ondernemer dit bedongen heeft en:

a. deze het gevolg zijn van wettelijke regelingen of bepalingen; of b. de consument de bevoegdheid heeft de overeenkomst op te zeggen met ingang van de dag waarop de prijsverhoging ingaat.

5. De in het aanbod van producten of diensten genoemde prijzen zijn inclusief btw.
6. Alle prijzen zijn onder voorbehoud van druk – en zetfouten. Voor de gevolgen van druk – en zetfouten wordt geen aansprakelijkheid aanvaard. Bij druk – en zetfouten is de ondernemer niet verplicht het product volgens de foutieve prijs te leveren.

  Artikel 10 - Conformiteit en Garantie

1. De ondernemer staat er voor in dat de producten en/of diensten voldoen aan de overeenkomst, de in het aanbod vermelde specificaties, aan de redelijke eisen van deugdelijkheid en/of bruikbaarheid en de op de datum van de totstandkoming van de overeenkomst bestaande wettelijke bepalingen en/of overheidsvoorschriften. Indien overeengekomen staat de ondernemer er tevens voor in dat het product geschikt is voor ander dan normaal gebruik.
2. Een door de ondernemer, fabrikant of importeur verstrekte garantie doet niets af aan de wettelijke rechten en vorderingen die de consument op grond van de overeenkomst tegenover de ondernemer kan doen gelden.
3. Eventuele gebreken of verkeerd geleverde producten dienen binnen X dagen/weken na levering aan de ondernemer schriftelijk te worden gemeld. Terugzending van de producten dient te geschieden in de originele verpakking en in nieuwstaat verkerend.
4. De garantie geldt niet indien:

o   De consument de geleverde producten zelf heeft gerepareerd en/of bewerkt of door derden heeft laten repareren en/of bewerken; o   De geleverde producten aan abnormale omstandigheden zijn blootgesteld of anderszins onzorgvuldig worden behandeld of in strijd zijn met de aanwijzingen van de ondernemer en/of op de verpakking behandeld zijn; o   De ondeugdelijkheid geheel of gedeeltelijk het gevolg is van voorschriften die de overheid heeft gesteld of zal stellen ten aanzien van de aard of de kwaliteit van de toegepaste materialen.   Artikel 11 - Levering en uitvoering

1. De ondernemer zal de grootst mogelijke zorgvuldigheid in acht nemen bij het in ontvangst nemen en bij de uitvoering van bestellingen van producten en bij de beoordeling van aanvragen tot verlening van diensten.
2. Als plaats van levering geldt het adres dat de consument aan het bedrijf kenbaar heeft gemaakt.
3. Met inachtneming van hetgeen hierover in artikel 4 van deze algemene voorwaarden is vermeld, zal het bedrijf geaccepteerde bestellingen met bekwame spoed doch uiterlijk binnen 30 dagen uitvoeren, tenzij consument akkoord is gegaan met een langere leveringstermijn. Indien de bezorging vertraging ondervindt, of indien een bestelling niet dan wel slechts gedeeltelijk kan worden uitgevoerd, ontvangt de consument hiervan uiterlijk 30 dagen nadat hij de bestelling geplaatst heeft bericht. De consument heeft in dat geval het recht om de overeenkomst zonder kosten te ontbinden en recht op eventuele schadevergoeding.
4. In geval van ontbinding conform het vorige lid zal de ondernemer het bedrag dat de consument betaald heeft zo spoedig mogelijk, doch uiterlijk binnen 14 dagen na ontbinding, terugbetalen.
5. Indien levering van een besteld product onmogelijk blijkt te zijn, zal de ondernemer zich inspannen om een vervangend artikel beschikbaar te stellen. Uiterlijk bij de bezorging zal op duidelijke en begrijpelijke wijze worden gemeld dat een vervangend artikel wordt geleverd. Bij vervangende artikelen kan het herroepingsrecht niet worden uitgesloten. De kosten van een eventuele retourzending zijn voor rekening van de ondernemer.
6. Het risico van beschadiging en/of vermissing van producten berust bij de ondernemer tot het moment van bezorging aan de consument of een vooraf aangewezen en aan de ondernemer bekend gemaakte vertegenwoordiger, tenzij uitdrukkelijk anders is overeengekomen.

  Artikel 12 - Duurtransacties: duur, opzegging en verlenging Opzegging

1. De consument kan een overeenkomst die voor onbepaalde tijd is aangegaan en die strekt tot het geregeld afleveren van producten (elektriciteit daaronder begrepen)  of diensten, te allen tijde opzeggen met inachtneming van daartoe overeengekomen opzeggingsregels en een opzegtermijn van ten hoogste één maand.
2. De consument kan een overeenkomst die voor bepaalde tijd is aangegaan en die strekt tot het geregeld afleveren van producten (elektriciteit daaronder begrepen)  of diensten, te allen tijde tegen het einde van de bepaalde duur opzeggen met inachtneming van daartoe overeengekomen opzeggingsregels en een opzegtermijn van ten hoogste één maand.
3. De consument kan de in de vorige leden genoemde overeenkomsten:

o   te allen tijde opzeggen en niet beperkt worden tot opzegging op een bepaald tijdstip of in een bepaalde periode; o   tenminste opzeggen op dezelfde wijze als zij door hem zijn aangegaan; o   altijd opzeggen met dezelfde opzegtermijn als de ondernemer voor zichzelf heeft bedongen. Verlenging

4. Een overeenkomst die voor bepaalde  tijd is aangegaan en die strekt tot het geregeld afleveren van producten (elektriciteit daaronder begrepen) of diensten, mag niet stilzwijgend worden verlengd of vernieuwd voor een bepaalde duur.
5. In afwijking van het vorige lid mag een overeenkomst die voor bepaalde  tijd  is aangegaan en die strekt tot het geregeld afleveren van dag- nieuws- en weekbladen en tijdschriften stilzwijgend worden verlengd voor een bepaalde duur van maximaal drie maanden, als de consument deze verlengde overeenkomst tegen het einde van de verlenging kan opzeggen met een opzegtermijn van ten hoogste één maand.
6. Een overeenkomst die voor bepaalde tijd is aangegaan en die strekt tot het geregeld afleveren van producten of diensten, mag alleen stilzwijgend voor onbepaalde duur worden verlengd als de consument te allen tijde mag opzeggen met een opzegtermijn van ten hoogste één maand en een opzegtermijn van ten hoogste drie maanden in geval de overeenkomst strekt tot het geregeld, maar minder dan eenmaal per maand, afleveren van dag-, nieuws- en weekbladen en tijdschriften.
7. Een overeenkomst met beperkte duur tot het geregeld ter kennismaking afleveren van dag-, nieuws- en weekbladen en tijdschriften (proef- of kennismakingsabonnement)  wordt niet stilzwijgend voortgezet en eindigt automatisch na afloop van de proef- of kennismakingsperiode.

Duur

8. Als een overeenkomst een duur van meer dan een jaar heeft, mag de consument na een jaar de overeenkomst te allen tijde met een opzegtermijn van ten hoogste een maand opzeggen, tenzij de redelijkheid en billijkheid zich tegen opzegging vóór het einde van de overeengekomen duur verzetten.

  Artikel 13 – Betaling en annulering

1. Voor zover niet anders is overeengekomen, dienen de door de consument verschuldigde bedragen te worden voldaan binnen 14 dagen na ontvangst van het product. In geval van een overeenkomst tot het verlenen van een dienst, vangt deze termijn aan nadat de consument de bevestiging van de overeenkomst heeft ontvangen.
2. De consument heeft de plicht om onjuistheden in verstrekte of vermelde betaalgegevens onverwijld aan de ondernemer te melden.
3. In geval van wanbetaling van de consument heeft de ondernemer behoudens wettelijke beperkingen, het recht om de vooraf aan de consument kenbaar gemaakte redelijke kosten in rekening te brengen.
4. In het geval van annulering van een dienst is kosteloze annulering mogelijk tot maximaal twee weken voor levering van de dienst. In het geval van annulering binnen twee weken van de levering van de dienst, worden er annuleringskosten in rekening gebracht. Deze kosten zijn 50% van de overeengekomen prijs.

  Artikel 14 - Klachtenregeling

1. De ondernemer beschikt over een voldoende bekend gemaakte klachtenprocedure en behandelt de klacht overeenkomstig deze klachtenprocedure.
2. Klachten over de uitvoering van de overeenkomst moeten binnen 7 dagen volledig en duidelijk omschreven worden ingediend bij de ondernemer, nadat de consument de gebreken heeft geconstateerd.
3. Bij de ondernemer ingediende klachten worden binnen een termijn van 14 dagen gerekend vanaf de datum van ontvangst beantwoord. Als een klacht een voorzienbaar langere verwerkingstijd vraagt, wordt door de ondernemer binnen de termijn van 14 dagen geantwoord met een bericht van ontvangst en een indicatie wanneer de consument een meer uitvoerig antwoord kan verwachten.
4. Een klacht schort de verplichtingen van de ondernemer niet op, tenzij de ondernemer schriftelijk anders aangeeft.
5. Indien een klacht gegrond wordt bevonden door de ondernemer, zal de ondernemer naar haar keuze of de geleverde producten kosteloos vervangen of repareren.

  Artikel 15 - Geschillen

1. Op overeenkomsten tussen de ondernemer en de consument waarop deze algemene voorwaarden betrekking hebben, is uitsluitend Nederlands recht van toepassing. Ook indien de consument woonachtig is in het buitenland.
2. Het Weens Koopverdrag is niet van toepassing.

  Artikel 16 - Aanvullende of afwijkende bepalingen Aanvullende dan wel van deze algemene voorwaarden afwijkende bepalingen mogen niet ten nadele van de consument zijn en dienen schriftelijk te worden vastgelegd dan wel op zodanige wijze dat deze door de consument op een toegankelijke manier kunnen worden opgeslagen op een duurzame gegevensdrager.

• 4 tot 2 weken voor het event: 75% van het totaalbedrag wordt in rekening gebracht
• Binnen 2 weken voor het event: 100% van het totaalbedrag wordt in rekening gebracht

Verplaatsingsbeleid:

Elke boeking bevat één mogelijkheid om gratis te verplaatsen naar een andere geplande datum indien nodig:

• Tot 6 weken voor het event: kosteloos

Binnen 6 weken voor het event geldt het annuleringsbeleid voor de verplaatsingskosten:

• 6 tot 4 weken voor het event: 50% van het totaalbedrag
• 4 tot 2 weken voor het event: 75% van het totaalbedrag
• Binnen 2 weken voor het event: 100% van het totaalbedrag

• 2 tot 1 week voor het event: neem contact met ons op om gratis te verplaatsen naar een latere datum van hetzelfde event. Als het een eenmalig event is of er zijn geen toekomstige data gepland, is deze optie mogelijk niet beschikbaar.
• Binnen 1 week voor het event:

Als je niet aanwezig kunt zijn, raden we aan je ticket door te verkopen aan een vriend of via TicketSwap. Als je een verklaring hebt ondertekend of bevestiging hebt gegeven van je begrip van contra-indicaties, laat het ons weten als je je ticket overdraagt, zodat de nieuwe deelnemer deze voorwaarden ook erkent.
